The Department of Insurance, Securities and Banking regulates service contracts and those who sell and are responsible for administering service contracts in the District of Columbia, pursuant to the Service Contract Regulation Act of 2018 (D.C. Official Code § 31-2351.01 et. seq.).
Service contract providers are not required to file forms or rates with the Department; however, service contract providers are required to register with the Department. The initial application fee and annual renewal fee is $200.00.
If you are contractually obligated to the service contract holder under the terms of the service contract you must register as a provider. As an obligor you are considered a “Provider” and must adhere to all registration requirements and service contract laws.
Except for the initial registration, a registration must be renewed annually. The renewal period is available 60 days prior to April 30. A completed registration application must be submitted to continue operating in the District of Columbia.
*All initial and renewal applications must be accompanied by all required documents.
The completed application and payment should be submitted through OPTins.

The following are exempt from the provisions of the Service Contract Regulation Act of 2018:
- Warranties;
- Maintenance agreements;
- Warranties, service contracts, or maintenance agreements offered by public utilities on their transmission devices to the extent they are regulated by the Public Service Commission;
- Service contracts sold or offered for sale to persons other than consumers;
- Service contracts on tangible property where the purchase price is $100 or less, excluding sales tax
- Motor vehicle manufacturers are exempt from the registration requirements of D.C. Official Code § 31-2351.03(d) and need only comply with D.C. Official Code §§ 31-2351.03(h)(1), 31-2351.04(a), 31-2351.05(d) through (l), 31-2351.06, and 31-2351.10, as applicable.
- If you are an entity or person not contractually obligated (financially responsible) under the terms of the service contract, you are not required to register.
- No person may perform or offer to perform work requiring registration under District of Columbia Code § 31-2351.01 et. seq. with an expired registration.
Service Contract Provider Renewal Application Instructions
Note: The completed application and payment should be submitted through OPTins.
Service Contract Providers:
- A registration must be renewed annually. The renewal period is available 60 days prior to April 30. A completed registration application must be submitted to continue operating in the District of Columbia.
- Non-receipt of a registration renewal notice from the Department does not exempt a provider from any requirements of this chapter.
- To renew a registration, a provider must submit:
(1) a completed application (on the Department approved forms).
(Note: All providers satisfying their financial responsibility requirement by using their parent company’s net worth and selects Option # 2 must acknowledge the parent company agrees to guarantee the obligations of the provider relating to service contracts sold by the provider in the District)
(2) the fee of $200 dollars is required to renew a registration.
(3) proof of new or continuing financial security responsibility is required to be submitted with the renewal application.
(4) a current letter of good standing must accompany your renewal registration; and
(5) a reimbursement policy does not need to be submitted unless there is a change in carrier.

If you are contractually obligated to the service contract holder under the terms of the service contract you must renew your register as a provider. As an obligor you are considered a “Provider” and must adhere to all registration (initial or renewal) requirements and service contract laws.
If you are an entity or person not contractually obligated (financially responsible) under the terms of the service contract, you are not required to renew your register.
No person may perform or offer to perform work requiring registration under District of Columbia Code § 31-2351.01 et. seq. with an expired registration.
