On July 2, 2010, the District enacted the Title Insurance Producer Emergency Act of 2010 (Act) as included in Act 18-0463, the Fiscal Year 2011 Budget Support Emergency Act of 2010. The Act provides that title insurance producers and companies operating in the District of Columbia will be subject to the regulation of the District of Columbia Department of Insurance, Securities and Banking (Department) effective January 1, 2011.
Title Insurance Rates and Forms
Effective that date, title insurance policy forms and rates used in the District of Columbia require filing and approval by the Department before use. To ensure these forms and rates are processed expeditiously, title insurers shall submit form and rate filings through the System for Electronic Rate and Form Filing (SERFF) at www.serff.com. A cover letter must accompany each filing and indicate that “this is a new filing” for any new filing. Title Insurance Producers
Title insurance producers must obtain an insurance license to operate in the District within 180 days of January 1, 2011. Resident producers, with the exception of title attorneys, are required to pass an examination; nonresident applicants will be granted licensure through reciprocity. To schedule an examination you must contact PearsonVue at pearsonvue.com. Producer licenses are effective for a two-year period and expire biennially on the birth month for an individual licensee, or on May 31st for firms. To renew the license, all resident title insurance producers and Title Insurance Attorneys must complete the listed below continuing education credits prior to the expiration date of the license. Beginning with the first renewal on or after December 2013, all non-resident title producers must complete four hours of DC-specific continuing education prior to the expiration date of their license. DC-specific courses are those courses which relate to title laws, regulations and industry practices in the District of Columbia.
